Article 1: Completeness
- These general terms and conditions express the entirety of the obligations of the parties. In this sense, the customer is deemed to accept without reservation all the provisions set out in these general terms and conditions. No general or specific condition appearing in documents sent or handed over by the customer may be incorporated herein, provided that these documents are incompatible with these general terms and conditions.
Article 2: Purpose
- These general terms and conditions aim to define the rights and obligations of the parties in the context of the online sale of goods and services offered by the company Botch Cargo Bikes to the customer.
Article 3: Entry into force and duration
- These general terms and conditions come into effect on the date of signature of the order form. These general terms and conditions are concluded for the duration necessary for the provision of the subscribed goods and services, until the expiration of the guarantees owed by the company Botch Cargo Bikes.
Article 4: Electronic Signature
- The customer's "final click" on the order form constitutes an electronic signature that has the same value as a handwritten signature between the parties.
Article 5: Order Confirmation
- The contractual information will be confirmed by email no later than at the time of delivery or, failing that, to the address provided by the customer in the order form.
Article 6: Proof of Transaction
- The computerised records, kept in the information systems of Botch Cargo Bikes under reasonable security conditions, will be considered as proof of the communications, orders, and payments made between the parties. The archiving of order forms and invoices is carried out on a reliable and durable medium that can be produced as evidence.
Article 7: Product Information
- Botch Cargo Bikes presents the products for sale on its website with the necessary characteristics that comply with Article L 111-1 of the Consumer Code, which provides for the possibility for the potential customer to know the essential characteristics of the products they wish to purchase before placing the final order.
Article 8: Price
- Prices are quoted in euros and are only valid on the date the order form is sent by the customer. They do not include delivery charges, which are billed separately and indicated before the order is confirmed. Prices include the applicable VAT on the day of the order, and any change in the applicable VAT rate will be automatically reflected in the price of the products in the online shop. The full payment of the price must be made at the time of ordering.
Article 9: Payment Method
- To pay for their order, the customer has the option of all payment methods specified in the order form. The customer guarantees to Botch Cargo Bikes that they have any necessary authorisations to use the payment method they have chosen when validating the order form. Botch Cargo Bikes reserves the right to suspend any order management and delivery in the event of a refusal of payment authorisation by credit card from officially accredited bodies or in the case of non-payment. Botch Cargo Bikes also reserves the right to refuse to make a delivery or honour an order from a customer who has not fully or partially paid for a previous order or with whom a payment dispute is currently being processed.
Article 10: Product Availability
- The order will be executed no later than within a period of 3 to 40 days from the day following the day the customer placed their order. In the event of unavailability of the ordered product, particularly due to our suppliers, the customer will be informed as soon as possible (on the same day in most cases) and will have the option to cancel their order. The customer will then have the choice to request either a refund of the amounts paid or an exchange of the product.
Article 11: Delivery Terms
- Products are delivered to the address provided by the customer on the order form. The customer is required to check the condition of the packaging of the goods upon delivery and to report any damage to the carrier on the delivery note, as well as to Botch Cargo Bikes, within a week.
Article 12: Delivery Issues Due to the Carrier
- Any anomaly regarding the delivery (damage, missing product compared to the delivery note, damaged parcel, broken products) must be indicated on the delivery note in the form of "written reservations," accompanied by the customer's signature. The customer must also confirm this anomaly by sending the carrier a registered letter with acknowledgment of receipt outlining the said claims within two working days following the delivery date. The customer must send us a copy of this letter by fax or regular mail.
Article 13: Delivery Errors
- The customer must submit any claim for delivery error and/or non-compliance of the products in nature or quality with respect to the indications on the order form to Botch Cargo Bikes on the same day as delivery or at the latest on the first working day following delivery. Any claim made after this period may be rejected. In the case of a delivery error or exchange, any product to be exchanged or refunded must be returned to Botch Cargo Bikes in its entirety and in its original packaging. To be accepted, any return must be reported in advance to Botch Cargo Bikes. Shipping costs are the responsibility of Botch Cargo Bikes unless it is an error on the part of the customer (model, colour, etc.), in which case the return and reshipping costs remain the responsibility of the customer.
Article 14: Product Warranty
- In accordance with articles L217-4 to L217-11, the Consumer Code imposes obligations on the seller: to deliver a good that is compliant with the contract and to respond to any defects in compliance existing at the time of delivery of the good. These legal articles thus impose a warranty of compliance on the seller. The warranty of compliance is free of charge. It is a legal and non-contractual obligation. The duration of the legal warranty of compliance is therefore two years. This period begins from the date of possession of the good.
- To be compliant with your order, the good must correspond to the description given on our site and possess the qualities presented or exhibit the qualities that a buyer can legitimately expect in light of the public statements made by the seller, the producer, or their representative, particularly in advertising or labelling.
- In this case, you should inform us in writing of the defects observed, by email to the address: thomas@botch-cargobikes.fror by post to the following address: Botch Cargo Bikes, 96bis, rue Général Bourbaki — 31200 Toulouse and return the product(s) to us. If the lack of conformity is confirmed, we will proceed with the exchange or repair of the item depending on the cost involved in accordance with Article L.211-9 of the Consumer Code.
Article 15: Liability
- The products offered comply with current French legislation. The company's liability cannot be engaged in the event of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities regarding the possibilities of importing or using the products or services you intend to order.
- Furthermore, the company cannot be held responsible for damages resulting from improper use of the purchased product.
- Finally, the company's liability cannot be engaged for any inconveniences or damages inherent in the use of the Internet, including service interruptions, external intrusions, or the presence of computer viruses.
Article 16: Right of withdrawal
- The customer has a period of 7 working days to return, at their own expense, products that are not suitable for them. This period starts from the day of delivery of the customer's order. If this period expires on a Saturday, Sunday, or public holiday, it is extended until the next working day. Any return must be reported in advance to Botch Cargo Bikes. Only products returned in their entirety, in their original complete and intact packaging, and in perfect resale condition will be accepted. Any product that has been damaged, or whose original packaging has been deteriorated, will not be refunded or exchanged. This right of withdrawal is exercised without penalty, except for return shipping costs. In the event of exercising the right of withdrawal, the customer has the choice to request either a refund of the amounts paid or an exchange of the product. In the case of an exchange, the reshipping will be at the customer's expense. In the event of exercising the right of withdrawal, Botch Cargo Bikes will refund the customer within 15 days. The customer will then be refunded by bank cheque or transfer.
Article 17: Force majeure
- Neither party shall be deemed to have failed in its contractual obligations, to the extent that their performance is delayed, hindered or prevented by an act of God or force majeure. Any facts or circumstances that are irresistible, external to the parties, unpredictable, unavoidable, independent of the will of the parties, and which cannot be prevented by them, despite all reasonably possible efforts, shall be considered as an act of God or force majeure. The party affected by such circumstances shall notify the other party within ten working days of the date on which it became aware of them. The two parties shall then come together, within one month, unless prevented by the force majeure event, to examine the impact of the event and agree on the conditions under which the performance of the contract will continue. If the force majeure event lasts longer than three months, these general conditions may be terminated by the affected party. Specifically, the following are considered as force majeure or fortuitous events, in addition to those usually recognised by the case law of French courts and tribunals: blockage of transport or supply means, earthquakes, fires, storms, floods, lightning; the interruption of telecommunications networks or difficulties specific to telecommunications networks external to the clients.
Article 18: Partial invalidation
- If one or more provisions of these general conditions are held to be invalid or declared as such under a law, regulation or as a result of a final decision of a competent court, the other provisions shall retain their full force and scope.
Article 19: No waiver
- The fact that one of the parties does not invoke a breach by the other party of any of the obligations referred to in these general conditions shall not be interpreted in the future as a waiver of the obligation in question.
Article 20: Title
- In the event of an interpretation difficulty between any of the titles appearing at the beginning of the clauses and any of the clauses, the titles shall be declared non-existent.
Article 21: Applicable law
- These general conditions are subject to French law. This applies to both substantive and procedural rules. In the event of a dispute or complaint, the customer shall first contact Botch Cargo Bikes to obtain an amicable solution.
